On July 31, the Michigan Supreme Court issued its decision in McCormick v. Carrier. As expected, the Court overruled the 2004 decision in Kreiner v. Fischer, which had been the seminal case construing the No-Fault Act's serious impairment threshold. Under the new ruling, the standard for "serious impairment of body function" is much less rigid.

This decision will significantly impact how defendants handle no-fault claims.
