Legal Malpractice Liability Defense
Smith Haughey and its legal malpractice attorneys have represented many law firms, lawyers, and legal malpractice insurers throughout Michigan and several other jurisdictions.
Notably, our firm is ranked "#1 in Michigan in Legal Malpractice Law" by The Best Lawyers in America. Seven of our legal malpractice attorneys have been selected to be included in the Michigan Super Lawyers listing. Our department chair, Jack Oostema, was selected by the Professional Liability Committee of the Litigation Section of the American Bar Association to serve as the author of the Michigan chapter for the publication entitled, "50-State Survey of Legal Malpractice Law," a comprehensive guide to legal malpractice law throughout the country.
Smith Haughey has defended large law firms in Michigan and federal courts, in cases involving practice in dozens of substantive practice areas including patent law, employment law, construction law, tax law and securities law. We have represented mid-size and smaller firms in matters involving family law, personal injury, the Uniform Commercial Code contract law and immigration law. We are on, or qualified to be on, every major insurance company's approved list of attorneys. We also act as national coverage counsel for a national legal malpractice insurer.
The complexity of legal malpractice involves not only typical litigation issues, but also the "case within the case" doctrine which requires an understanding of a broad range of legal disciplines and issues.
Representing attorneys and law firms also requires an understanding of the emotional toll a malpractice claim takes on a client. Understanding that toll and the feelings and responses can be as important as understanding the underlying case itself.
Everyone on our legal malpractice team is experienced in partnering with our clients, not only in the defense of claims, but also in identifying strategies to repair the claim prior to suit. We seek out the best and most able expert witnesses and evaluate preliminary motions that may result in an early termination of the lawsuit or a narrowing of the issues. We have the ability to offer risk management suggestions for firms based on our long and deep experience with claims made against legal and many other professionals.
Our legal malpractice lawyers are also well-versed in the Canons of Professional Ethics. Our attorneys have extensive experience as members of the State Bar of Michigan Character and Fitness Committee, the Grievance Commission and the Board of Law Examiners. We have represented clients before the Grievance Commission and on occasion the State Bar itself.
Smith Haughey is acutely aware of the confidentiality that is required of lawyers representing law firms. We treat information about lawyers' billing, hiring, quality control and administrative practices with the utmost confidentiality.
Our attorneys are committed to providing a well-reasoned and vigorous defense, while keeping in mind the client's personal needs, requirements and relationships.
