Smith Haughey attorneys Kristen Guinn and Katie Wendt recently obtained victory in the Michigan Court of Appeals for our client, a health insurance company. Guinn and Wendt had obtained a favorable ruling by the trial court, which was appealed by the plaintiff. The Michigan Court of Appeals affirmed the trial court’s decision, again deciding in our client’s favor. The plaintiff had claimed entitlement to recovery for medical expenses under two different insurance policies, but based on the comprehensive breakdown of pertinent policy provisions put forward by Guinn and Wendt, both the trial and appellate courts agreed that the plaintiff could not obtain duplicate benefits.
